No smoking or no screaming kids allowed

A North Carolina restaurant says screaming children are no longer welcome and that has some parents outraged.

There's a new item on the menu at Olde Salty Restaurant on Carolina Beach. And it may be hard for some parents to digest. No screaming children. Brenda Armes, Olde Salty's owner says, "If they find it offending, I suggest that they find another restaurant to eat at that does tolerate it, because we're not going to."

Armes is tired of hearing her customers complain about screaming kids while they're trying to dine. So she put up these signs inside and out. She says, "It has brought us in more customers than it's ever kept away."

Gary Gibson is a first time customer. He says, "Having grandchildren, going into restaurants with them is not very enjoyable when you hear a bunch of kids screaming. So, it is nice to see a sign like that up."

But these parents from West Virginia don't think the signs are so nice. Ashley Heflin says, "I've never seen a restaurant say don't bring your screaming kids in here. You can't help if your kids scream."

Armes certainly thinks you can. That's why she confronted the Heflins during our interview with them. Armes says, "You don't think it's fair that I ask you if you're sitting at my table?" Heflin says, "Personally, if I saw that, I wouldn't even come in the restaurant." Armes responds, "I understand, I understand."

It was then that the Heflins' baby started to cry. In question was whether that would be tolerated in the restaurant. Heflin says, "I mean, he cries like that... other kids cry."

Armes says, "That's a crying baby. Here's a screaming child. Wah! Wah! Wah!"

Regardless, all Armes asks is that if your child is screaming, you take them outside. Armes says, "We aren't saying your child can't have fun. We're not saying your child can't be in here."

Still, the policy from armes has parents up in arms over their next meal. The owner says if a patron's child acts up, a restaurant worker will ask the parents to take the child outside. Armes says she won't ask parents, or their children, to leave the restaurant for good.

WALTHAM (AP) — A 20-year-old man in Vermont could soon be lighter in his wallet for allegedly sending a text message over his cell phone while riding his motorcycle.

Vermont State Trooper Andrew Laise said he saw Joshua Kelly riding his motorcycle with one hand on his handle bars and one hand on a cell phone. The trooper said he could see Kelly using his thumb to hit buttons on his cell phone while he was riding on Route 7 in Waltham.

Police say after he was stopped, Kelly admitted he had been texting his boss while riding his motorcycle.

He was issued a traffic ticket for texting while riding, which carries a fine of up to $156 for a first offense.

The question of whether police will be required to ask people if they are in this country legally is now in the hands of Gov. Jan Brewer.

On a 17-11 margin Monday, the state Senate gave final approval to a package of changes in state law that proponents say will help crack down on illegal immigration. Sen. Russell Pearce, R-Mesa, the architect of the plan, said state action is necessary because of the political failure in Washington to secure the border.

While some changes are minor, like making it a crime to stop in traffic to solicit a day laborer, the heart of the bill is aimed at what Pearce said is “removing the handcuffs” from local police.

To that end, SB 1070 would overrule any policy or procedure of a city council or police department that keeps officers from enforcing federal immigration laws. It also says that, when practicable, police must inquire about the immigration status of those they encounter as part of their regular activities.

And to ensure compliance, the legislation permits anyone who believes police aren’t doing all they should to file suit, with judges required to impose fines of up to $5,000 a day if the citizen suit succeeds.

It also lets police arrest illegal immigrants and charge them with the state crime of not carrying their visas or resident alien documents issued by the U.S. government.

Sen. Linda Lopez, D-Tucson, said the result will be racial profiling.

Pearce said that’s not the case, pointing to language in the legislation which forbids race or ethnicity from being used as the sole factor in stopping and questioning someone.

But Thomas Saenz, president and general counsel of the Mexican American Legal Defense and Education Fund, told Capitol Media Services that any use of race in questioning someone is unconstitutional. He said if Brewer signs the measure, MALDEF intends to sue to stop the law from taking effect.

Brewer was noncommittal Monday when asked about the legislation. But the governor did say she wanted to examine the provisions to ensure the measure does not violate equal rights or promote racial profiling.

“I’m always concerned about all those things,” she said.

“We will look at it and we will review it,” Brewer continued. “I will make a decision when the bill arrives on my desk.”

Brewer has to act before Sunday.

If she signs it — and if it is not blocked by the courts — the legislation likely would become the toughest state law on the issue of illegal immigration.

Central to that is the language requiring police to check the immigration status of those they encounter, language Pearce said is designed to wipe out the “sanctuary policies” of cities. He said politicians and others have handcuffed police, keeping them from finding and apprehending those who are in this country illegally.

He said there’s nothing racist about it.

“Illegal is not a race,” Pearce said. “It’s a crime.”

The bottom line, said Pearce, is that citizens have “a constitutional right to expect our laws to be enforced.”

Sen. Thayer Verschoor, R-Gilbert, said state action is necessary.

“We’ve had an abdication of our federal government’s responsibility to enforce immigration laws here, protect our borders, protect us from the criminals that are crossing our borders, who are killing our citizens, who are robbing their homes, invading their homes,” he said.

Sen. Rebecca Rios, D-Apache Junction, agreed that the federal government has not secured the border. But she said this is not the answer.

“This bill does nothing to address human smuggling, the drug cartels, the arms smuggling,” she said.

“My concern is, it creates a lot of negative effects that none of us here want, but it doesn’t address the bigger issue,” Rios continued. “And, yes, I believe it will create somewhat of a police state.”

Philosophy aside, Pearce said Congress never preempted local police from enforcing immigration laws. “That has never been done,” he said.

“States have inherent authority to enforce these laws as if they were written into the state statutes,” Pearce continued. “The only impediment has been political.”

Saenz, however, said the wording of the federal statutes specifically reserves all rights to enforce immigration laws to federal officials and those they designate. He said that preemption will form another basis for a federal court challenge if Brewer signs the bill.

Pearce said he is unconcerned. He said challenges to similar bills have been rejected, one to a law requiring people to prove citizenship to register to vote and identification to the polls, the other to a law making it illegal for employers to knowingly hire undocumented workers.

The measure has divided the law enforcement community, with organizations made up of rank-and-file officers in support while the Arizona Association of Chiefs of Police has been concerned about the possible citizen lawsuits.

Cochise County Sheriff Larry Dever told Capitol Media Services said concerns of profiling are overblown. “It’s not unusual for police to ask people for ID,” he said.

But Yuma County Sheriff Ralph Ogden said he is concerned that in his county, which is more than one half Hispanic, the chances are good that the law will be used to detain U.S. citizens.

Pearce said Ogden’s fears are political “because he’s weak-kneed, like many other folks, about enforcing the law.”
